These Terms of Use apply to the entire contents of the Site, the Applications and to any correspondence with you and/or any third party instructed by us. By accessing, browsing, using or registering with the Site and/or the Applications you agree to be bound by these Terms of Use including use of your personal information in accordance with the UENI Website and Apps Privacy and Cookies Policy and the Request Booking Terms which form part of these Terms of Use. If you do not accept these Terms of Use, please do not use the Site and/or Applications.

We are continually improving our methods of communication and adding new functionality and features to the Site and/or Applications. If and when our data practices change and/or we update these Terms of Use, we will (as soon as practicable) post the changes on this Site to notify you of the changes. Intellectual Property Rights

UENI Limited is the owner or licensee of all intellectual property rights in this Site, the Applications and all materials published on this Site and/or the Applications. The content is protected by copyright laws and treaties around the world. The content may not be copied other than for your personal and non-commercial use with all copyright or other proprietary notices retained. We may at any time revoke the licence to use content on this Site and/or the Applications.

No Reliance on Information

The content of the Site and the Applications is provided for general information purposes only. The content does not provide you with any advice or recommendation of any kind. We endeavour to keep content updated, but we cannot guarantee that the content is accurate, complete or up to date. In particular, we rely on third party service providers for accuracy of product and service information including pricing. As such, we cannot guarantee that the products and/or services will be available, that the prices stated are correct or that products and/or services will be as described on the Site and/or the Applications.

Accessing the Site & Applications

Access to the Site and/or Applications is provided on a temporary basis and we reserve the right to withdraw and/or amend the Site, the Applications and/or any products or services offered on them without notice. We will not be liable for the Site, the Applications and/or any products or services offered on them not being available or being interrupted at any time for any period.

We may, from time to time, restrict access to certain features, parts or content of the Site and/or Applications, or the entire Site and/or Applications, to users who have registered with us and we assume no responsibility for any such interruptions. The Site and/or Applications may also be unavailable from time to time due to maintenance or malfunction or for other reasons outside our control and we assume no responsibility for any such malfunctions, delays or interruptions.

It is your responsibility to ensure that your equipment meets all the necessary technical specifications to enable you to access and use the Site and/or Applications and is compatible with the Site and/or Applications.

Child safety

Protecting the safety of children when they use the Internet is very important to us. You must be 18 or over to request bookings for services or to live book the services available through the Site or the Applications. If you are under 18, you must have parental consent to use the services. We recommend that children receive permission from their parent or guardian before gaining access to the Site or any Applications or sending personal information to us or anyone else online.

Limitation of Liability

The Site and Applications are provided for domestic and private use. You agree not to use the Site and/or Applications for any commercial or business purposes unless you have been approved by us as a service provider.

We will not be liable under these Terms of Use for any loss or damage caused by us or our affiliates in circumstances where: (a) there is no breach of legal duty of care owed to you by us; (b) such loss or damage is not a reasonably foreseeable result of any such breach; and (c) any increase in loss or damage results from a breach by you of these Terms of Use. Our liability shall not in any event include losses related to you such as, lost data, lost profits or business interruption. Nothing in these Terms of Use shall limit or exclude our liability for death or personal injury resulting from our negligence or negligence of our employees, affiliates, contractors or agents.

We will take all reasonable measures to protect this Site and the Applications against computer viruses, worms, Trojan horses or other threats. We do not, however, warrant that this Site and/or the Applications are free from such harmful programs and we are not responsible for any loss incurred by you due to harmful programs received from this Site and/or the Applications or by means of files downloaded from this Site and/or the Applications.

The Site and Applications may, from time to time, include links to third-party websites and applications. We include these to provide you with access to information, products and/or services that we believe you may find useful or interesting. We have no control over links to third-party websites found on this Site and/or the Applications and the existence of such links should not be interpreted as our endorsement of any information, product or service that is offered or reached through such websites. If you follow a link to any of these third-party websites we will not be liable for any loss or damage that may arise from your use of them. Please contact us about any links from our Site and/or the Applications or linking to our Site and/or the Applications which you believe are inappropriate and/or illegal.

We reserve the right, at our discretion, to prohibit or remove (without notice) any link from another website to materials or information on this Site and/or the Applications. Creation of such links for commercial purposes is only permitted with our prior consent. Creation of such links for non-commercial purposes is permitted subject to the following conditions: (i) you own the website from which the link to our Site is placed; (ii) you link to, but do not replicate, the homepage of the Site; (iii) you link to our Site in a way that is fair and legal and does not damage our reputation or take advantage of it; (iv) you do not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists; and (v) you do not create a frame or any other browser or border environment around the Site.

User Generated Content

By submitting content (other than your personal information) to the Site and/or the Applications you confirm that you have the right to use the same and a submission together with your agreement to these Terms of Use shall constitute an assignment to us of any intellectual property rights in such content. Any content you upload to the Site and/or the Applications will be considered non-confidential and non-proprietary, and we have the right to use, copy, remove, distribute and disclose to third parties any such content for any purpose including (but not limited to) use of such content at our own discretion (with or without accreditation) in any media.

We do not actively moderate or pre-screen user generated content submitted to the Site and/or the Applications however, we reserve the right to remove, edit, modify or refuse to publish without notice any content which we believe to be in any way unlawful, threatening, abusive, harmful, pornographic, obscene, vulgar, indecent, offensive or which infringes on the intellectual property rights or other rights of any third party. To the extent that user breaches these terms, UENI reserves the right to terminate the user’s account.

General Terms

These Terms of Use are personal to you and you shall not assign or transfer any of your rights or entitlements under these Terms of Use to any third party without our prior written consent.

We may terminate this Site and/or the Applications, for any or no reason, at any time with or without notice and without any liability for us.

We may terminate these Terms of Use if: (a) you have breached any material provisions of these Terms of Use (or acted in a manner which clearly shows that you do not intend to, or are unable to comply with the provisions of these Terms of Use); or (b) we are required to do so by law.

If any provision of these Terms of Use is found by a court of competent jurisdiction to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible.

Governing Law and Venue

These Terms & Conditions, its subject matter and its formation, shall be governed by English law, and you agree that any dispute between you and us regarding them or the Site and Applications will only be dealt with by the English courts, provided that, if you are a consumer and not a business user and do not live in England, the applicable law of the country in which you live will govern and any dispute will only be dealt with by the courts there. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.

Request for Booking Terms & Conditions

Introduction

Our Site and Applications allow you to search for local services provided by different businesses near your location such as, hairdressers or gyms (Service Providers). You can also request bookings with selected Service Providers and provide reviews for the services received. It may also be possible to connect your Application account with your social media accounts and share information, for example, about upcoming bookings, Service Providers you like and services you received.

If and when we update these Terms & Conditions, we will (as soon as practicable) post the changes on this Site to notify you of the changes. We encourage you to check this page frequently. These Terms & Conditions were last updated on 21 July 2017.

Request for Bookings – Making and Attending

You can use the Site and/or Applications to request bookings with selected Service Providers. This encompasses requests for booking at a single Service Provider and requests for bookings at several Service Providers. We are responsible for taking requests for bookings as the commercial agent of selected Service Providers featured on the Site and/or Applications. However, the contract for the services is between you and the relevant Service Provider and we are not responsible or liable to you for the actual services booked.

You should check all details and any restrictions relating to a service before making a request for booking as you are subject to any terms and conditions set by the Service Provider at the time of request for booking. It is your sole responsibility to advise the Service Provider in advance of the appointment of any health-related conditions that might be relevant to the provision of the services. If you fail to disclose such information, neither UENI nor the relevant Service Provider shall be liable for any loss or damage resulting from the services which could have been avoided if you had previously disclosed such information.

When you make a request for booking through the Site or Applications, you will receive an email confirmation stating the time, date, and service requested, along with the price of the service (if price information is available). Once the Service Provider confirms acceptance of your request (or you and the Service Provider agree to an alternative date and time for service), a contract will come into existence between you and the relevant Service Provider. The Service Provider will charge you directly for the services requested and any additional services or products that you purchase when you attend your booking.

We reserve the right to suspend or terminate your account if we suspect abuse of the request booking or request quote functionality on the Site or Applications.

Bookings – Amending and Cancelling

If you subsequently amend or cancel your request for booking, any amendment or cancellation (and any full or partial refunds due to you, as may apply) shall be in accordance with the Cancellation Policy of the Service Provider. The Service Provider reserves the right to withhold a refund of payments made by you if you do not give sufficient notice of any cancellation.

Services

The services are provided by the Service Providers and not by us. The provision of the services is the responsibility of the relevant Service Provider who must provide the services to you with reasonable skill and care.

All services shown on the Site and/or the Applications are indicative and subject to availability. All prices are indicative only. Although we require Service Providers to provide us with up-to-date and accurate content and information we cannot verify all content and/or information provided to us.

Customer Service

You should contact the relevant Service Provider with any complaints regarding the receipt of services provided to you. The Service Provider is solely responsible for delivering the services they have advertised.

However, we want you to have a good experience when using the Site and Applications and when booking services or requesting bookings for services with our Service Providers. If you wish to make a complaint about one of the Service Providers, please write to us at bookings@ueni.com.

Following the receipt of a complaint, we will contact the Service Provider and investigate the situation. Nevertheless, the Service Provider and not UENI is fully responsible for the delivery of the services.

Limitation of Liability

This is the privacy and cookies policy for each of our website (Site) and mobile applications (Applications) that we make available from time to time. The Site and Applications will be owned and operated by UENI Limited (we, us and our). For the purposes of EU data protection laws, we are the data controller.

We are committed to protecting your privacy on-line. We appreciate that you do not want the personal information you provide to us to be distributed indiscriminately and here we explain how we collect information, what we do with it and what controls you have over it. This privacy policy is also part of our Website and Applications' Terms of Use (the "Terms of Use") for the Site and Applications.

By using the Site or any Applications, you consent to the collection and use of your personal information in accordance with this privacy policy. If you do not agree with the use of your personal information as set out in this privacy policy, or the Terms of Use, please do not use this Site or any of the Applications.

Information we may collect from you

  • information (such as your name, email address, gender, date of birth, photographs, postal address and telephone number) that you provide by completing forms on the Site or any Applications, including if you register as a user of the Site or any Applications, book an appointment for any service, upload or submit any material via the Site or any Applications, contact any service provider via the Site and/or Applications or enter into any competition or promotion we may sponsor.
  • in connection with an account sign-in facility, your log-in and password details;
  • information made available to us through third party sign-in services such as Facebook;
  • the content of any communications you send to us, for example, to report a problem or to submit queries, concerns or comments regarding the Site or any Applications or its content;
  • any search terms you looked up and results that you selected;
  • friend or contact lists that you may provide to us by connecting your UENI account with your computer, mobile device, or third-party social network accounts;
  • information from surveys that we may, from time to time, run on the Site or any Applications for research purposes, if you choose to respond to, or participate in, them;
  • geographical location so that we can provide you with information about the services provided by businesses near to your location; and
  • other information from your use of the Site or Applications including, the type of internet browser or mobile device you use, any website from which you have come to the Site and your IP address (the unique address which identifies your computer or mobile device on the Internet) and your operating system, which are automatically recognised by our web server.

Your name, as well as any photo you submit for your profile, any services or any businesses that you book appointments with and any recommendations you make, can be publicly displayed as part of your profile. Appointments booked will also be publicly displayed on the applicable service provider's profile. You can make changes to some of your account information through Settings.

You are under no obligation to provide any such information. However, if you should choose to withhold requested information, we may not be able to provide you with certain services.

Uses made of your information

Subject to your prior consent, where required under applicable data protection laws, we may use your personal information to:

  • provide you with the services and information offered through the Site or Applications and which you request;
  • in connection with an account sign-in facility, your log-in and password details;
  • administer your account with us;
  • verify financial transactions in relation to payments you make online;
  • audit the downloading of data from the Site or Applications;
  • improve the layout and/or content of the pages of the Site or Applications and customise them for users;
  • inform you of changes to the Site or Applications;
  • carry out research on our users' demographics and tracking of sales data; and
  • send you information we think you may find useful or which you have requested from us, including information about our products and services or those of carefully selected third parties, provided you have consented to being contacted for these purposes.

We may also share your personal information with carefully selected third parties so they can send you information directly which you may find useful regarding their products and services although, such third parties may have their own privacy policies and we are not responsible for how those third parties use your personal information. However, you will only receive these communications where you consented to receive such communications either at the point of registration or at any point after. You can unsubscribe from such communications at any time, by changing your communication preferences in Settings, via the unsubscribe link that you will find at the bottom of every marketing email we send or by contacting us on email at business@ueni.com. However, if you do unsubscribe you may not be able to benefit from the full service and functionality of UENI and potential promotions.

Refer a Friend Schemes

We may, from time to time, run referral programmes or similar initiatives, such as a "Refer a Friend" programme, that invite you to provide us with the contact details of someone who is known to you who may find our products or services to be of interest. We will only use those contact details for the purpose of the relevant initiative (and not for general marketing purposes). By providing us with their details, you confirm that you have their permission to do so and must not provide us with the details of anyone from whom you do not have such permission. We reserve the right to identify you as the person who has made the referral in the message that is sent to them. We will not use your friend's information for any other purpose unless they consent to us doing so.

Information sharing

We may disclose aggregate statistics about visitors to the Site, users of the Applications, customers and sales in order to describe our services to prospective partners, advertisers, sponsors and other reputable third parties and for other lawful purposes, but these statistics will include no personally identifiable information.

We may disclose your personal information to any of our affiliates, service providers, or to our agents or contractors who assist us in providing the services we offer through the Site or any Applications, processing transactions, booking appointments for the services, fulfilling requests for information, receiving and sending communications, updating marketing lists, analysing data, providing support services or in other tasks, from time to time. When you interact with the Site or any Applications, we try to make that experience simple and meaningful. Payment processing

Payments made on the Site or any Applications are made through our payment gateway providers, Stripe, GoCardless or PayPal. You will be providing credit or debit card information directly to our third-party payment gateway providers, which operate secure servers to process payment details, encrypting your credit/debit card information and authorising payment. Information which you supply to our third-party payment gateway providers are not within our control and is subject to that provider’s own privacy policy and terms and conditions. We reserve the right to offer other payment gateway providers in the future.

Security and storage of your personal information

We place great importance on the security of our users' personal information. We have security measures in place to help us protect against the loss, misuse and alteration of personal information under our control. For example, our security and privacy policies are periodically reviewed and enhanced as necessary and only authorised personnel have access to personal information. Whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it.

You should bear in mind that submission of information over the Internet is never entirely secure. We cannot guarantee the security of information you submit via the Site or any Applications whilst it is in transit over the Internet and any such submission is at your own risk.

We will only store your personal information for as long as we legitimately need it or for as long as required by law.

Transfers out of the EEA
